Legal Services - Private client

We undertake the full range of residential conveyancing work, including sales, purchases, mortgage work such as securities and discharges. We aim to provide a confidential, speedy and reliable service for a realistic fee. Please contact Hannah Pearson or Gillian Bowman in the first instance.

We are able to advise on the options available to you in preparing a straightforward will, and what rights members of your family may be able to insist upon in relation to your estate. We can discuss what might happen to your estate if you do not leave a will, and the differing roles of executor and beneficiary. We can arrange to have your will registered to prevent problems arising in the event that the original goes astray.

We can assist in the administration of estates in accordance with the terms of a will, or where the deceased person does not have a will. We can handle those aspects of the winding up of estates, which require to go through court procedures (known as “confirmation“ in Scotland, like “probate” in England).”

As many of us are living much longer, but, of course, run the risk later, of not being fully able to manage our own affairs, it is advisable to make arrangements to allow someone else, usually a family member, to manage matters for us, if the need arises. This can be arranged by having a power of attorney prepared and registered whilst one still has mental capacity to understand what we are doing. We can prepare such a power of attorney for you
Unfortunately, there can arise situations where we are unable mentally to manage our own affairs and may have not had a power of attorney prepared. In that situation, one might not then have the mental capacity to instruct a power of attorney to be prepared, and it might therefore be necessary to make an application to the court for the appointment of a guardian. This is a process that we can handle for you, or a family member or friend. The court would be likely to formally appoint a guardian, and to set out the extent of the powers which the guardian can operate, where it is satisfied that a guardian is necessary, and that the proposed guardian is suitable and will act in the best interests of the person in question. The actions of the guardian are subject to the oversight of the Public Guardian.
